BAS is banned in Ukraine

On September 2, 2024, Presidential Decree No. 601/2024 put into effect the decision of the National Security and Defense Council of Ukraine from September 2, 2024, “On the application of the cancellation and introduction of amendments to personal special economic and other restrictive measures (sanctions).”

The new version extended the sanctions on the sale, support, and distribution of software products harmful to national security and Ukrainian businesses. The use of not only the entire software products but also their individual components was also banned.

According to Appendix 5 to the decision of the National Security and Defense Council of Ukraine from September 2, 2024, “On the application of the cancellation and introduction of amendments to personal special economic and other restrictive measures (sanctions)”, the hidden European clone of 1C – BAS, was added to the list of software products subject to sanctions for the first time. This includes: “BAS ERP”, “BAS Holding Management”, “BAS Corporate Document Management”, “BAS Trade Management”, “BAS Retail”, “BAS Corporate Accounting“, and other BAS software products, as well as “UA-Budget”.

The ban on the use of sanctioned software currently only applies to state enterprises and institutions, but this is the first official step toward recognizing the entire BAS (Business Automation Software) line as Russian software.

We also remind you that on August 19, 2024, the draft law 11492 On Amendments to the Law of Ukraine ‘On Sanctions’ Regarding the Ban on the Use of Software Products and Access to Electronic Information Resources was registered in the Verkhovna Rada of Ukraine.

The bill was developed to enhance Ukraine’s cybersecurity by implementing sectoral sanctions that prohibit or restrict the use of software products developed by entities from foreign states subject to sanctions and limit access to specific information resources.

According to an official comment from the State Special Communications Service, this means that legal entities will be prohibited from using software created in or by companies connected to aggressor countries. Access to websites and services that pose a threat to national security will also be restricted.
